"GAME: Break in Nouvelle-Aquitaine" INSTAGRAM GAME Terms and Conditions

ARTICLE 1: ORGANISER

The company EASYVOYAGE SAS (hereinafter the "organiser"), with its registered office at 2 rue Paul Vaillant-Couturier, CS 92 300 LEVALLOIS PERRET, whose main activity is Travel and media comparator in the tourism sector, organises an online game entitled "GAME: Break in Nouvelle-Aquitaine" (hereinafter referred to as "the game"). This no-purchase game entitled "GAME: Break in Nouvelle-Aquitaine" can be found on the ExploreFrance Instagram page
This game is not managed, sponsored by or associated with Instagram.

ARTICLE 2: CONDITIONS OF PARTICIPATION / GAME CONDUCT

2.1
The game starts on November 21, 2022, at 10 am and ends on December 30, 2022, at 10 am. This Game is accessible on the Internet on the Instagram page at the following address: https://www.instagram.com/explorefrance (Lien externe) (hereinafter referred to as the "Site").

2.2
This game is open to any adult natural person residing in the United Kingdom, Belgium, the Netherlands, Germany and Spain, who has an Instagram account, with the exception of the staff from EASYVOYAGE, its subsidiaries, the company ADICTIZ and SAMPLEO and its partners ASSET FRANCE and CRT NOUVELLE AQUITAINE (hereinafter "its partners"), and service providers providing the prizes involved in the contest.

2.3
To participate, you must:

  1. Go to the Instagram Explore France page at the following address: https://www.instagram.com/explorefrance (Lien externe) between November 21, 2022, and December 30, 2022.
  2. Have a registered Instagram account
  3. Go to the post for the game (animated visual)
  4. Like the Instagram page @Explorefrance
  5. Comment on the post with the following elements:
    "Which iconic city in Nouvelle-Aquitaine is known for its wine?"
  6. Enter the country of residence
    If the participant's comment does not meet these conditions, their participation in the game cannot be taken into account
    Any form of participation other than that mentioned above is excluded.

2.4
Each participant may comment on the post only once in an attempt to win the prize stipulated in section 3 of these terms and conditions.

2.5
Any incomplete registration or registration with incorrect information that prevents the participant from being contacted in the event of winning the prize, as well as any participation by a person not entitled to play, will be considered null and void.
Any prize that, for any reason whatsoever, has not been awarded, will remain the exclusive property of the organiser, who will be free to dispose of it at its discretion.

2.6
Comments posted must comply with the Instagram Terms of Service as well as the following conditions: The comments must not include any obscene, insulting, racist, discriminatory language, animal abuse or violence.
The organiser may disqualify any participant who does not comply with these terms and conditions, in particular if the comment does not comply with the social network’s terms of service or these terms and conditions.

Dordogne Valley: 2 tickets to visit Château de Monbazillac in the Dordogne Valley (value €20) - valid until 11/11/2023
Pau-Pyrénées: 2 Grand Faim Passes (value €30) - valid until 31/12/2023

The following are not included in the value:
-Travel to cities
-Accommodation

ARTICLE 4: SELECTION OF WINNERS

A single draw will be held to designate 5 x 2 winners from all Instagram entries on December 30, 2022, at 12: 00 p.m.

The list of participants in the game will correspond to the total number of valid comments collected under the dedicated post on Instagram and grouped in an Excel table, and the selection will be made randomly using the formula = ALEA.ENTER.BORNES (1;"Number of participants") from among all the comments recorded throughout the duration of the game, to designate 5 x 2 winners.

ARTICLE 5: DELIVERY OF PRIZES

Commenters chosen as winners will be notified of their win on the Instagram @ExploreFrance page in response to their comment by the Instagram @ExploreFrance account. They will then be contacted by private message via @ExploreFrance. They will be invited to contact the organiser by private message within 5 days of the notification to establish the mode of awarding the prize. Winners will receive the award via e-mail in PDF format. After failure to contact within 5 days, the new winner will be drawn for the given award.

The organiser cannot be held responsible for non-publication of the comments announcing the win or messages communicating the mode of awarding of the prize, in the event of failure of the access provider, the Internet network, or the social network page.

The organiser cannot be held responsible if the winner and/or his/her partners cannot benefit from the prize:

  • due to the transmission of incorrect information by the winner or contact after the communicated deadline,

The prizes may not give rise to any dispute of any kind from the winners, nor to a transfer of their equivalent value in money, nor any assignment from the winner to a third party, nor to their replacement or exchange for any reason whatsoever.
If circumstances so require, the organiser reserves the right to substitute another prize of an equal or higher commercial unit value for the proposed prize at any time. It is understood that the organiser cannot be held liable for this fact.

ARTICLE 6: LIMITATION OF LIABILITY

6.1
The organiser, as well as its partners, cannot be held liable for:
● any direct or indirect damage that would in any way result from connection to the site or downloading the application
● technical faults, in particular network faults, electrical or computer faults. It is the responsibility of all participants to take all appropriate measures to protect their own data and/or software stored on their computer equipment against any infringement. The publication of photos to participate in the game is done at the participant’s responsibility.
● any technical malfunction and network failure, unless this is due to reckless or intentional actions, for which the organiser would be responsible.

6.2
The organiser can only be held liable for the prize provided in these terms and conditions in the event of a technical failure affecting the number of winners.

ARTICLE 7: EXCLUSION FROM OR PREMATURE TERMINATION OF THE GAME

7.1
If a user is suspected of having violated the participation conditions, the organiser reserves the right to exclude them from the game without warning. This also applies to persons who use prohibited/illicit tools (e.g. hacking tools, viruses, Trojans, etc.) or acquire other benefits by manipulation.
In addition, people who participate on behalf of third parties (with or without their consent) may be excluded from the game. Moreover, participation by lottery clubs, automated services and, above all, professional lottery services is not possible.

7.2
The organiser will take all necessary measures to ensure compliance with the terms and conditions. It cannot be held responsible if the present game were to be modified, postponed, cancelled or interrupted, and will have the possibility to do so at any time without warning or without indicating the reasons.
The organising company will use this possibility in particular if the execution in a regulatory manner is not possible for technical reasons (e.g. viruses in the computer system, manipulations or errors in the software) or legal reasons. If such a termination results from the behaviour of a participant, the organiser reserves the right to require this person to repair the damage incurred.
Any change affecting these terms and conditions or the progress of the game will be the subject of an amendment posted on the site.

ARTICLE 8: REQUEST FOR INFORMATION

Any request or claim regarding the development of the game and the awarding of prizes must be sent in writing to the organiser at the latest by February 21, 2023, to the following address: dpo@webedia-group.com. Requests or claims transmitted at a later date will not be processed.

ARTICLE 9: PROTECTION OF PERSONAL DATA

Under the applicable provisions, in particular, the General Data Protection Regulation (GDPR), the organisers of this game are responsible for separate processing and undertake to implement all appropriate security measures for the use of your personal data.
The data collected to organise the attribution of your prize will be shared for this purpose only with the game’s organising partners.
Participants have rights of access to their data, rectification and deletion as well as opposition, for legitimate reasons, to its processing. These rights can be exercised with the data controllers via the following e-mail address: dpo@webedia-group.com.
The integrity of the personal data protection policy applied in the context of the game is detailed in the document "INFORMATION RELATING TO PERSONAL DATA PROCESSING", freely accessible on the site.

ARTICLE 10: ACCEPTANCE OF THE TERMS AND CONDITIONS

If the participant has expressly authorised it by replying explicitly to the message sent by ATOUT FRANCE on Instagram instant messaging, their post/comment may be reproduced and used for information purposes only related to the game on the Instagram account @ExploreFrance on a story visible 24 hours a day. This use will not confer on the participants any right to compensation or any benefits whatsoever other than the attribution of the prize won if they prove to be drawn as a winner.
Participants authorise all verifications concerning their identity and age. Provision of any false information concerning identity or address will lead to immediate elimination from the game.
Participation in the game implies acceptance of these terms and conditions and the information leaflet relating to data protection.

10.2
The organiser has drawn up these terms and conditions in application of French law and Directive 2005/29/EC of the European Parliament and of the 11 May 2005 Council.

10.3
Any practice of application or interpretation of these terms and conditions will be decided exclusively by the organiser.

10.4
Any dispute related to the game will be submitted to the competent court in Paris.

Data recipients

The collected data is intended for the organiser, its partners and service providers organising the "GAME: Break in Nouvelle-Aquitaine" competition, for the sole purpose of participating in the game, managing the winners and awarding prizes.
It can also be collected, used and stored by Meta, through which the participant is brought to participate in the game. As such, the participant is informed that the organiser is not responsible for the processing of their personal data carried out by Meta as part of the participant's use of social network platforms.

Duration of data retention
